We are frequently asked how much does probate cost. It depends on the agreement between you and the attorney. Fiduciary Fees are a probate cost set by law, Revised Code Section 2113.35: 4% of the first $100,000 of probate assets; 3% of the next $300,000; and 2% of the assets above $400,000. So the Attorney may receive the statutory fee, or he may choose hourly billing, depending upon the case. In Guardianships, the fees are generally less than in an estate administration.
